You can definitely take legal action if you have evidence she wasn't hurt, or at least mitigate the "consequences" of doing absolutely nothing to her. But don't let her just take your money, anyway

When considering your thread title, consider the following...
When "correcting" somebody by your own hand it is very easy to get caught, especially when you have a motive.
It is often better and safer to use 3rd party professional services to get a clean job done, with no loose strings and a more "appropriate" murder put behind bars.

Oh heck no! It's unfortunate that there are people out there like that. That happened to me YEARS ago, the other party waited until 5 days before the statute of limitations expired to file a claim even though they weren't hurt. I never had to go to court but my insurance did pay them $5000. :-/
In your case, I'd fight the hell out of it. Especially if the 2nd car hit her and not yours.
If the police investigated the cause of the wreck and if anyone took pictures of the scene, then there should be enough proof from the angles/positioning of the damages that you are not at fault. Since I am assuming that the police were called, who did they charge with the wreck/ticket?
